Sharing Children In Separated Families

The Government is considering a radical proposal to give divorced parents automatic shared custody of their children.

Under the Family Law Act, there are no presumptions about which parent a child in a separated family will live with, or how much contact the non-resident parent will have.

While the act stipulates divorced parents continue to have full parental responsibility for their children, it specifically states this doesn’t mean presumed equal custody. The act encourages parents to agree on living arrangements and contact. When they cannot agree, the Family Court makes the relevant orders, and under the act the Court must make the best interests of the child its paramount consideration.

All of this sounds sensible, but there is one group in the family law equation ---fathers--- that manifestly feels it is discriminating against them. The vast majority of children in separated families live with their mothers. Only 16 per cent of divorced couples in Australia have the children living with each parent for more than 30 per cent of the time. Post-separation arrangements are much better accepted by women than by men.

Under the changes being considered by the Government, the present system would be replaced by “rebuttable joint custody”, where there would be a presumption that each child should spend equal time living with both parents, unless there are strong reasons against it.

While the idea sounds attractive, if taken up it should supplement, not override, the principle of the best interests of the child.
